Terms of Service

1. Acceptance of terms

By signing up for or using Certvik, you agree to these Terms of Service ("Terms"). If you are using Certvik on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of service

Certvik is a cloud-based compliance automation platform that integrates with Microsoft 365 to support ISO 27001 and SOC 2 compliance programs. We provide evidence collection, control monitoring, reporting and workflow tools. Certvik does not provide legal, audit or certification services.

3. Subscriptions and payment

Certvik is offered on a subscription basis. By subscribing, you authorise us to charge your payment method on a recurring basis at the applicable rate. All fees are exclusive of VAT or other applicable taxes.

You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

4. Free trial

New accounts receive a 14-day free trial. A card is required to continue after your trial. At the end of the trial period, your account will enter read-only mode unless you subscribe. Trial data is retained for 90 days after trial expiry before deletion.

5. Acceptable use

You agree not to:

  • Use Certvik for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to any part of the service or its infrastructure
  • Reverse engineer, copy or create derivative works from the Certvik platform
  • Use Certvik to process data you do not have the right to process

6. Data and intellectual property

You retain all rights to your data. By using Certvik, you grant us a limited licence to process your data for the purpose of providing the service. We retain all rights to the Certvik platform, software and documentation.

7. Limitation of liability

Certvik is provided "as is". To the maximum extent permitted by applicable law, we exclude all warranties, express or implied. Our total liability to you shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential or punitive damages.

8. Uptime and service levels

We target 99.5% monthly uptime for the Certvik platform, excluding scheduled maintenance. We do not guarantee any specific uptime and are not liable for service interruptions outside our control.

9. Termination

We may suspend or terminate your account if you breach these Terms or fail to pay outstanding fees. You may terminate your account at any time. Upon termination, your data will be retained for 90 days before deletion.

10. Changes to terms

We may update these Terms from time to time. We will notify you by email of material changes. Continued use of Certvik after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Poland. Disputes shall be resolved in the competent courts of Poland.
